Terms and Conditions
These terms apply to the use of QuizYou and to purchases you make in the browser edition at quizyou.fun/app. Purchases made in the App Store or on Google Play are additionally governed by the terms of the store in question; there, your contractual partner for the purchase is Apple or Google respectively, not GuruSense UG.
§ 1 Provider and scope
(1) The provider and your contractual partner is GuruSense UG (haftungsbeschränkt), Eichelsheimer Straße 5, 68163 Mannheim, represented by Daniel Defiebre, registered with Amtsgericht Mannheim under HRB 753579, VAT ID DE453596516 (hereinafter “we” or “us”). Full details are in the legal notice.
(2) These terms apply to consumers and to businesses alike. We recognise conflicting terms only where we have expressly agreed to them in writing.
(3) The language of the contract is German. Versions of these terms in other languages are reading aids only; the German version is the authoritative one and prevails in the event of any divergence.
§ 2 What QuizYou is
(1) QuizYou is a quiz game for exactly two people. Every match is one against one – against another person or against a computer opponent at one of three strengths. The game runs in the browser, on iOS and on Android.
(2) Free of charge and without an account you get every game type, both kinds of opponent, the online duel and six question categories. There is no advertising, no subscription and no feature that only a purchase unlocks.
(3) An account is needed only for an entry in the public leaderboard, for the friends list and for reporting other players’ display names.
§ 3 What you can buy
(1) The only paid items are seven further question categories: Sport, Science, History, Literature, Celebrities, Series & TV, and Curiosities. Each can be bought individually, and all seven together as a bundle.
(2) What you buy is permanent access to a category, not a particular number of questions. The size of a category changes with content updates; we do not warrant a fixed number of questions.
(3) When you bring a purchased category into a match, the person you are playing with plays it too, without having bought it. That does not give the other person any entitlement of their own to the category.
(4) These are one-off purchases. There is no term, no automatic renewal and no recurring charge.
§ 4 Formation of the contract
(1) The presentation of the categories in the game is not a binding offer but an invitation to you to make one.
(2) When you select a category or the bundle, a checkout window opens, run by our service provider RevenueCat, with the payment handled by the payment service provider Stripe. There you see the product, the price and the total amount. By pressing the payment button you make a binding offer. The contract is formed once payment has been confirmed and the category has been unlocked.
(3) Your contractual partner is us, not RevenueCat and not Stripe. Both act on our behalf: RevenueCat provides the checkout and the receipts, Stripe processes the payment. On your card statement the purchase appears as QuizYou.
§ 5 Prices and payment
(1) All prices are final prices in euros and include statutory VAT, currently 19 %. No additional costs arise. What governs is the price shown to you immediately before you pay.
(2) Credit card, Apple Pay and Google Pay are available. RevenueCat determines which payment methods are offered, and that selection may change. PayPal and SEPA direct debit are not offered at present.
(3) You enter your payment details in the checkout window alone. We neither see nor store them. The details are set out in our privacy notice.
(4) Anyone who first buys a category individually and later buys the bundle pays for both – earlier individual purchases are not credited against the bundle price. To keep that from happening, we hide the bundle as soon as buying the remaining categories individually would cost less. If it happens anyway, write to us at support@gurusense.de: we will refund the difference.
§ 6 Receipt and confirmation of the contract
(1) After every purchase you receive, without having to ask, a receipt at the email address given at checkout, stating what was bought, the amount, the VAT shown separately and our company details; it is also available as a PDF download. It is sent on our behalf by RevenueCat; the PDF version is currently available in English only.
(2) These terms, the withdrawal instructions and the model withdrawal form can be viewed, saved and printed from these pages at any time. On request we will also send them to you by email – a short message to support@gurusense.de is enough.
§ 7 Unlocking, account and device binding
(1) The category you buy is unlocked immediately after payment has been confirmed. No registration is required for this.
(2) Without an account, a purchase stays tied to the browser in which it was made. We then assign the purchase to an anonymous identifier held in your browser data. If you clear the site data, switch browser or device, or buy in a private window, the purchase cannot be recovered. Unlike the iOS and Android apps, the browser edition has no restore function that could bring back a purchase made without an account.
(3) We therefore expressly recommend creating an account before or immediately after a purchase. With an account, the purchase applies on every device and in every edition of QuizYou that you sign in to with the same account – including the iOS and Android apps.
(4) Signing out of your account does not take purchased categories away from you; they are available again once you sign back in.
§ 8 Right of withdrawal
(1) As a consumer you have a statutory right to withdraw within fourteen days of the conclusion of the contract. The details and the model withdrawal form are set out in the withdrawal instructions.
(2) We do not invoke early expiry of the right of withdrawal under § 356 Abs. 6 BGB (German Civil Code), even though we unlock the category immediately. Your right of withdrawal remains in place for the full fourteen days, even if you have already played the questions you bought. We claim no compensation for value received.
(3) On withdrawal we refund the full purchase price and access to the category ends.
§ 9 Rights in the content you buy
(1) You receive a simple, non-transferable right of unlimited duration to use the category you have bought within QuizYou for private purposes.
(2) You may not pass on, sell or lend your access; you may not extract, reproduce or publish the questions outside the game; and you may not attempt by technical means to get around the access controls on categories you have not bought.
§ 10 Provision, updates and changes
(1) The statutory rules on digital products apply to the content you buy (§§ 327 ff. BGB). We provide the category in the form agreed and supply the updates needed to keep it in conformity with the contract – for 24 months from your purchase. After that, the category remains usable for as long as QuizYou is operated; there is then no further entitlement to updates.
(2) We add, revise and remove individual questions. Such changes to the content are part of the product and do not in themselves constitute a defect, so long as the size and character of the category are preserved.
(3) We reserve no wider right to make changes. § 327r BGB would allow one only where provision is continuous; your purchase is a one-off purchase. What we change about a category therefore stays within the bounds of paragraph 2.
(4) Should we discontinue QuizYou or individual game types, we will give reasonable notice. Claims under §§ 327 ff. BGB remain unaffected.
§ 11 Availability
(1) Access to purchased content requires an internet connection. Brief interruptions caused by maintenance, by faults at our service providers or by force majeure are usual for services of this kind; we remedy them without delay. We neither promise nor exclude a particular availability rate – what applies is what you may expect of a service of this kind.
(2) Online duels, purchasing and synchronising your entitlements require an internet connection. If your entitlements are temporarily unavailable because our payment service provider is down, purchased categories cannot be played for that period; your entitlement itself remains.
(3) System requirements. The browser edition needs a current browser with JavaScript and WebGL enabled and access to browser storage over a secure connection (HTTPS). Testing is done against current Chromium browsers. In a private window, some browsers do not make persistent browser storage available; the game then runs with the bundled questions only. The iOS edition requires iOS 15 or later, the Android edition Android 8 or later.
§ 12 Remedies for defects
The statutory remedies for defects apply. If content you have bought is not in conformity with the contract, you may demand that it be brought into conformity and, where the statutory conditions are met, reduce the price or bring the contract to an end. An informal message to support@gurusense.de is enough.
§ 13 Your obligations, display names and suspension
(1) Other players see your display name and, if you use the feature, the messages you choose to send on the shared results screen. This content must not infringe third-party rights, be insulting, discriminatory or misleading, or contain contact details.
(2) We may change a display name or remove it from the leaderboard if it breaches paragraph 1 or has been reported independently by several people.
(3) Reporting and moderation (Art. 14, 16 DSA). Every display name and every question can be reported within the game. Messages on the results screen are shared privately between the two participants in that game. The speech-bubble menu lets you report a received message and block the other player. We review reports manually. A name is removed from the public leaderboard as soon as two independent people have reported it; we assess reported questions on their merits. If you disagree with a decision, you can ask us to review it at support@gurusense.de.
(4) In the event of serious or repeated breaches – in particular manipulation of the scoring, abusive use of the invitation route or circumvention of purchase controls – we may suspend access to the account-linked features and terminate the free contract of use for the account for cause. Before a suspension we will draw the breach to your attention and give you an opportunity to comment; where a breach is severe we suspend at once and hear you afterwards. You may object to a suspension at any time at support@gurusense.de.
§ 14 What a suspension does not affect
Your purchases are separate contracts and are unaffected by a suspension. We do not take purchased categories away from you as a sanction. If we suspend your account permanently, we will on request refund the purchases you can no longer use as a result.
§ 15 Minimum age
(1) Paid purchases may only be made by persons with full legal capacity, or by minors with the consent of their legal guardian. No technical age verification takes place.
(2) If a child has bought something without that consent, write to us at support@gurusense.de – we will refund the amount. This applies irrespective of the withdrawal period.
(3) An entry in the public leaderboard requires a minimum age of 16 (Art. 8 DSGVO).
§ 16 Liability
(1) We are liable without limitation for intent and gross negligence, for injury to life, body or health, and under the German Product Liability Act.
(2) For ordinary negligence we are liable only for breach of a material contractual obligation – that is, an obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance you may regularly rely – and then limited in amount to the foreseeable damage typical of this kind of contract.
(3) Liability is otherwise excluded.
§ 17 Changes to these terms
Amended terms apply only to contracts concluded after the amendment. Purchases already concluded remain governed by the version in force at the time of purchase; we do not reserve any deemed consent for ongoing contracts.
§ 18 Final provisions
(1) The law of the Federal Republic of Germany applies, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. If your habitual residence is in another country, the mandatory consumer protection rules of that country remain unaffected by this choice of law (Art. 6 Abs. 2 Rom-I-VO, the Rome I Regulation).
(2) We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board (§ 36 VSBG).
(3) Should any provision of these terms be invalid, the remainder of the contract remains effective.
